A broken pool heater is at the center of a tenant’s $154,000 lawsuit against their previous landlord.

A broken pool heater has escalated into a heated legal battle, as a couple renting a high-end home in White Plains filed a $154,000 lawsuit against the property owner over unresolved pool problems.

Sara and Aaron Kaplan, the tenants, allege that Taylor Howard, a Plano, Texas resident, failed to uphold the terms of their lease, according to a complaint filed in Westchester Supreme Court.

“The promise of a heated outdoor pool was particularly important to the Kaplans’ decision to execute the lease agreement and move into the property,” the complaint asserts. “Without the amenity, the Kaplans never would have agreed to lease the property at all, let alone for $11,500 a month.”

Howard’s attorney, John A. Sarcone III, told reporters the claims is baseless. “My client complied with what was required to be corrected,” Sarcone stated via email. “This lawsuit is frivolous.”

The dispute centers on a classic brick colonial home located on Rosedale Avenue near Maple Moor Golf Course. The property features five bedrooms and four baths and was purchased by Howard in 2018 for $1.2 million. Today, its estimated value exceeds $2 million, according to Zillow.

The Kaplans entered a 13-month lease beginning June 1, 2023, but claim that numerous issues were apparent from the start. Among their complaints were a broken pool heater, damaged walls, chipped paint, broken closets, missing door and window screens, and a rusted backyard swing set.

The Kaplans assert that Howard and his property management company promised immediate repairs to the pool, which was central to their decision to rent the home. However, by September 2023, the heating system for the pool was still not operational, prompting the couple to withhold rent payments.

The couple filed a lawsuit against Howard in November 2023, seeking $34,000 for the loss of the pool’s use during the summer and $100,000 to cover relocation costs to another property with a functional pool.

In response, Howard countersued for unpaid rent in White Plains City Court. Both parties reached a settlement in January 2024, where Judge John P. Collins Jr. issued an eviction warrant but delayed its enforcement until after the lease expired in July. As part of the agreement, the Kaplans paid $57,500 in back rent, and Howard agreed to address several repairs.

The Kaplans now contend that many of the promised repairs were never completed and argue that the pool, a key feature of their lease, remained unusable throughout their tenancy. According to their complaint, the pool later developed leaks, became unsanitary, and even housed dead rodents for weeks.

“Time has made clear that defendants never intended to fulfill their lease agreement or settlement agreement obligations,” the complaint alleges.

The Kaplans are demanding $154,000 in damages for breach of contract.

Sarcone, Howard’s attorney, maintains that the current lawsuit rehashes settled claims. He emphasized that the previous lawsuits were dismissed with prejudice, barring the Kaplans from making the same claims again.

“They mask the same claims with allegations almost a year later that my client did not comply with the terms of the stipulation from the City Court,” Sarcone stated.

He further criticized the latest filing, saying, “My client shall also seek sanctions for frivolous conduct,” accusing the Kaplans of reviving allegations they had already agreed to drop after “getting their proverbial asses handed to them for breach of the lease agreement.”

The legal battle now hinges on whether the Kaplans’ new allegations represent distinct grievances or an impermissible attempt to revisit resolved disputes.

When it comes to efficient pool maintenance, selecting the right cartridge filter replacement can have a profound impact on service schedules, inventory management, and operational costs. Cartridge filters, like those offered by Pleatco and discussed by Scott Gleason and Kevin Stewart of Pentair Pool on the Pool Magazine podcast, offer pool service professionals a way to streamline their operations.

You won’t need to maintain a large inventory of different brands, which makes things much simpler,” Stewart said.

Pleatco’s ultra-line cartridges are particularly noteworthy because they combine multiple filter functions into a single, versatile product, fitting a wide variety of pool systems. This consolidation minimizes inventory while ensuring professionals are prepared for various service scenarios.

Using high-quality cartridges not only saves time but also reduces operational costs. Gleason explained that opting for cheaper, lower-quality filters often leads to more frequent cleanings and service visits. “While some pool owners may focus on the initial cost, higher-quality cartridges offer long-term savings by extending cleaning intervals and ensuring optimal filtration,” Gleason noted.

Pleatco’s cartridges also help conserve water. Cartridge systems eliminate the need for backwashing, a process required with sand filters that wastes chlorinated water. Stewart pointed out, “Skipping backwashing avoids chemical loss and aligns with water conservation efforts, especially in regions with water restrictions.”

Cartridge filters offer several advantages over traditional sand filters. Stewart noted that “cartridge filtration delivers better water clarity by capturing particles nearly twice as small as sand filters.” Additionally, cartridge systems provide greater square footage for water filtration, reducing the frequency of cleanings.

Sand filters require frequent backwashing, which can occur weekly, while cartridge filters may only need cleaning every few months. The absence of backwashing in cartridge systems not only saves water but also simplifies maintenance, reducing downtime for pool owners.

The Avia HD with Nitek by Raypak is more than just another pool heater; it’s a breakthrough in heat exchanger technology, offering durability without compromising efficiency. Brad Duncan, National Pool Products Trainer at Raypak, shared insights about the new heater during a recent interview on Pool Magazine’s podcast and at the Pool Industry Expo in Monterey, CA.

At the heart of the Avia HD with Nitek lies an innovative heat exchanger technology that sets it apart from conventional heaters. Traditionally, pool heaters use Cupro-nickel, an alloy of copper and nickel, which offers enhanced durability for harsh pool conditions. However, this added durability comes at a cost to efficiency. Duncan explained, “When we make metal harder, we make it slightly less efficient.”

The Avia HD overcomes this issue by taking a different approach. “Rather than mixing nickel into the copper, we coat the entire surface with nickel,” said Duncan. “This method ensures that the hardest part of the material is right where it’s needed the most—on the surface.”

The result is a heat exchanger with 300% more erosion resistance and 50% less scaling than standard Cupro-nickel exchangers. Duncan emphasized, “This is the first time anyone in the industry has achieved this level of durability without sacrificing efficiency.”

Raypak developed the Avia HD with Nitek by incorporating feedback from pool owners and professionals. “We used what we call VOC—Voice of Customer,” said Duncan. “When we started developing this heater, we went directly to customers to find out what they wanted in a pool heater.”

This approach yielded practical insights, including the demand for built-in WiFi for remote operation without the need for additional automation systems. “They also wanted the heater to be smaller and more efficient than our previous model,” Duncan shared. “We delivered on both counts.”

The app allows users to set schedules, adjust temperatures, and receive alerts about potential issues. Duncan explained, “For example, if a skimmer basket gets clogged and restricts water flow, causing the heater to shut off, the app will send a notification right to your phone.”

This functionality is designed to empower both homeowners and service professionals. “It’s about giving pool owners and techs the ability to manage issues proactively,” Duncan said.

One of the most practical aspects of the Avia HD with Nitek is its ability to serve as a drop-in replacement for existing heaters of similar size. For pool professionals, this feature means installations are faster and less complicated. “For starters, it’s a drop-in replacement for similarly-sized heaters on the market,” Duncan explained. “The plumbing and the gas lines will match up perfectly. You take the small footprint heater out, you put an Avia in its place, and it will line up perfectly.”

This thoughtful design feature reduces installation time, which allows service professionals to maximize their efficiency. It also eliminates the need for complicated plumbing modifications, saving time and money for pool companies.

Unlike some heaters with side-opening junction boxes that can pose challenges when placed near walls or other obstructions, the Avia HD offers easy access from above. “You may be aware of a heater with a side junction box that opens sideways,” said Duncan. “That can be a problem if the heater is installed close to a wall. We don’t have that issue. Everything opens from the top.”

This top-access design minimizes the need to move or reposition equipment, streamlining the maintenance process and reducing downtime for customers.

Another service-friendly feature is the Avia HD’s use of a straight-tube heat exchanger, which enhances durability and makes repairs less frequent. “We designed the straight-tube heat exchanger to minimize degradation,” said Duncan. “Without bends in the tubes, the heat exchanger is much less vulnerable to damage over time.”

This design reduces maintenance frequency and extends the heater’s lifespan, allowing technicians to spend less time on repairs and more time on proactive maintenance or other service calls.
